Welcome to Feast Factory, developed and published by Blazing Heart Studio (“Company”, “we”, “us”, or “our”).

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Player”, or “you”) and Blazing Heart Studio governing your access to and use of the Feast Factory mobile application downloaded from the Google Play Store, as well as any associated websites (https://blzheart.com), content, and online services (collectively, the “Service”).

BY DOWNLOADING, INSTALLING, ACCESSING, OR PLAYING FEAST FACTORY, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL, COPY, ACCESS, OR PLAY FEAST FACTORY.

1. Eligibility & Google Play Account

1.1 Age Requirement

To play Feast Factory, you must be of legal age to form a binding contract in your jurisdiction. If you are under the age of majority in your jurisdiction (typically under 18 years old), your parent or legal guardian must review and agree to these Terms on your behalf prior to your use of Feast Factory.

1.2 Google Play Account

To download Feast Factory, receive automatic updates, and make in-app purchases, you must have a valid Google Account and comply with the Google Play Terms of Service (https://play.google.com/about/play-terms/).

2. Limited License Grant

Subject to your continued compliance with these Terms, Blazing Heart Studio grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and execute one copy of Feast Factory on an Android device owned or controlled by you, solely for your personal, non-commercial entertainment purposes.

License Restrictions

You agree that you will not:

  • Copy, modify, adapt, translate, reverse engineer, decompile, or disassemble Feast Factory or any portion thereof.
  • Distribute, lease, rent, sublicense, publish, or sell Feast Factory or modified APK files to any third party.
  • Create derivative works based on Feast Factory’s code, 2D art, animations, recipes, characters, or audio assets.
  • Circumvent or disable any technological protection measure, security control, or digital rights management implemented in Feast Factory.
  • Use Feast Factory for any commercial purpose, public performance, or commercial broadcast without prior written approval.

3. In-App Purchases & Google Play Billing

3.1 Virtual Goods and Currency

Feast Factory may offer optional virtual currency (e.g., coins, gems, recipe tokens) and virtual goods (e.g., kitchen expansions, chef outfits, speed boosters, ad-free access) (collectively, “Virtual Goods”).

  • Digital License Only: Virtual Goods are licensed, not sold. You acquire a limited, personal, revocable license to use Virtual Goods strictly within Feast Factory.
  • No Real-World Monetary Value: Virtual Goods have no monetary value outside of Feast Factory and cannot be redeemed, transferred, exchanged, or converted into real money, goods, or cash equivalents from Blazing Heart Studio or any third party.
  • Modifications: Blazing Heart Studio reserves the right to manage, regulate, control, modify, or eliminate Virtual Goods and in-game economy balance at any time without liability.

3.2 Payment Processing via Google Play

  • All in-app purchases in Feast Factory are processed through the Google Play In-App Billing API.
  • Payment is charged to your designated payment method through your Google Play account upon purchase confirmation.
  • Prices for Virtual Goods are specified in the in-game shop and may vary by region and applicable local taxes.

3.3 Refund Policy

Except as required by applicable mandatory consumer laws or provided under the Google Play Refund Policy:

  • All purchases of Virtual Goods in Feast Factory are final and non-refundable.
  • If you made an unintentional purchase or have a billing issue, you may request a refund directly through the Google Play Store pursuant to Google’s policies (Google Play Refund Assistance).
  • If you receive a refund for an in-app purchase from Google Play, Blazing Heart Studio reserves the right to deduct or revoke the corresponding Virtual Goods or restore your game progress to a pre-purchase state.

4. User Conduct & Fair Play Rules

We are committed to maintaining a fun, secure, and fair environment for all Feast Factory players. You agree to adhere to the following rules:

Prohibited Conduct

  1. Cheating and Exploits: You shall not use cheats, automated software, bots, hacks, mods, memory editing applications (such as GameGuardian, Cheat Engine, or Lucky Patcher), auto-clickers, or unauthorized third-party software to alter game values, speed up factory production, or bypass gameplay systems.
  2. Account Tampering: You shall not manipulate local game save files, spoof device IDs, or inject modified network payloads.
  3. Disruption: You shall not attempt to overwhelm, disrupt, or attack servers, networks, or cloud save infrastructure supporting Feast Factory.
  4. Commercial Exploitation: You shall not sell, auction, or transfer your Feast Factory game account, save progress, or in-game inventory for real money.
  5. Abusive Behavior: If multiplayer, leaderboards, or community features are enabled, you shall not submit offensive, hateful, defamatory, or inappropriate player names or user content.

Enforcement

Blazing Heart Studio reserves the right to investigate violations and take appropriate disciplinary action, including issuing warnings, rolling back game progress, resetting leaderboard scores, or permanently suspending access to Feast Factory without compensation.

5. Intellectual Property Rights

Blazing Heart Studio retains all right, title, and interest in and to Feast Factory, including without limitation:

  • All computer code, scripts, software architectures, and algorithms.
  • All visual assets, graphic designs, 2D cartoon illustrations, user interface designs, animations, and character models.
  • All recipe systems, kitchen themes, gameplay mechanics, and level designs.
  • All audio, sound effects, musical scores, and voice tracks.
  • The trademarks, service marks, trade names, and logos associated with Feast Factory and Blazing Heart Studio.

Nothing in these Terms grants you any ownership or intellectual property rights in Feast Factory beyond the limited personal entertainment license expressly granted herein.

6. Game Updates and Service Changes

To enhance performance, introduce new recipes, balance factory mechanics, and provide security patches:

  • Blazing Heart Studio may deliver automatic or recommended updates through the Google Play Store.
  • You may need to install the latest version of Feast Factory from Google Play to continue enjoying all features and cloud synchronization.
  • Blazing Heart Studio reserves the right to modify, suspend, or discontinue Feast Factory or any feature thereof at any time.

7. Account Termination & Data Deletion

By You

You may stop playing Feast Factory at any time simply by uninstalling the application from your device. If you wish to delete your player account and all associated data, you can submit a deletion request as described in our Privacy Policy Data Deletion Section.

By Us

Blazing Heart Studio reserves the right to suspend or terminate your access to Feast Factory immediately, without prior notice, if you breach these Terms, engage in fraudulent transactions, or use unauthorized hacks or cheat tools. Upon termination, your right to use Feast Factory ceases immediately, and any unused Virtual Goods are forfeited without compensation.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • FEAST FACTORY IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
  • BLAZING HEART STUDIO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
  • WE DO NOT WARRANT THAT FEAST FACTORY WILL BE UNINTERRUPTED, SECURE, BUG-FREE, OR ERROR-FREE, NOR THAT DEFECTS WILL BE IMMEDIATELY CORRECTED.
  • YOU ACKNOWLEDGE THAT YOUR USE OF FEAST FACTORY IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • IN NO EVENT SHALL BLAZING HEART STUDIO, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, WORK STOPPAGE, OR DEVICE MALFUNCTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE FEAST FACTORY.
  • IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO BLAZING HEART STUDIO FOR FEAST FACTORY IN-APP PURCHASES IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR FIFTY U.S. DOLLARS ($50.00 USD), WHICHEVER IS GREATER.

Feast Factory may integrate or link to third-party services, including Google Play Services, Google AdMob, and analytics tools. Your use of such third-party services is subject to their independent terms and privacy practices. Blazing Heart Studio is not responsible or liable for any third-party services, content, or advertisements.

11. Dispute Resolution & Governing Law

These Terms and any dispute arising out of or related to Feast Factory shall be governed by and construed in accordance with the laws applicable to Blazing Heart Studio, without regard to its conflict of law principles.

Before initiating any formal legal proceeding, you agree to contact us at info@blzheart.com to attempt to resolve any dispute or claim informally and amicably.

12. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blazing Heart Studio regarding Feast Factory, superseding all prior agreements or understandings.
